FLASH: Indonesia's ESDM claims that companies without 2026 RKAB must respond within a week or face suspension, revocation risk

On April 21, 2026, Indonesia's Ministry of Energy and Mineral Resources (ESDM) held an online meeting for mining license (IUP) holders that have not yet submitted their 2026 Work Plan and Budget (RKAB). The regulator reiterated that these companies had already received up to three written warnings (SP1–SP3), and failure to comply will trigger phased penalties.

 

Under the latest regulation (Permen 17/2025), RKAB must be submitted annually, no later than 45 days before the start of the year. The previous three-year RKAB expired on March 31, 2026, and is no longer valid.

 

The penalty process begins with three warnings (SP1-SP3), followed by a suspension of production or operations for up to 60 days. If a company fails to rectify the situation within that period, its IUP may be revoked.

 

During the meeting, several companies highlighted common issues:

  • PT Bintang Delapan Wahana has received the third warning (SP3) but cannot submit RKAB because its Minerba One system account has not been activated.
  • CV Yulan Pratama has not received any warning letters and is stuck at the feasibility study (FS) approval stage, with repeated revisions since January.
  • Kristalin Eka Lestari only gained system access in November 2025 and remains in the process of multiple FS revisions.
  • PT Asia Pasifik has not received warning letters and encounters system errors when trying to submit a "zero-production RKAB".
  • Genba Indo Resource has not been registered in the Minerba One system and cannot perform any submissions.
  • PT MSG has not received the three warning letters; it has submitted for three of its five IUPs, with the remaining two stuck at the FS input stage.

 

Other companies, including PT Aulia Prima Perkasa, KUD Numontang, PT Bumi Halteng Mining, and Trinusa Resources, face similar issues such as not receiving notifications, not being registered in the system, or lengthy FS review cycles.

 

Despite these difficulties, the regulator stressed that they do not excuse non-compliance. All companies must fulfill their 2026 RKAB submission obligations. Companies must:

  • Formally respond to the third warning (SP3)
  • Explain their current RKAB submission progress and stage
  • Provide supporting documents such as system screenshots
  • Note that failure to respond to SP3 will be considered non-compliance, triggering the next penalty phase
  • Submit their response or explanation within one week
  • Provide a written explanation even if temporarily unable to submit RKAB (e.g., due to FS or system limitations)

 

ESDM stated that all IUP holders must take this regulatory requirement seriously and complete their RKAB submission or submit a progress explanation as soon as possible. Failure to respond as required will result in production suspension (for up to 60 days) and subsequent risk of mining license revocation.
